Preparing for the Renters’ Rights Act
The Renters’ Rights Act is set to reshape how landlords manage and maintain rental properties. Use this checklist to make sure you’re compliant, confident, and ready for what’s ahead.
1. Understand the Key Changes
- Section 21 “no-fault” evictions abolished and possession must be sought on specific grounds.
- Fixed-term tenancies replaced with rolling periodic agreements.
- Rent increases limited to once per year with challenge rights for tenants.
- Tenants can end their tenancy with two months’ notice.
- Ban on refusing tenants with children or benefits.
- Stronger property standards and local authority enforcement.
2. Review Your Tenancy Agreements
- Replace any Assured Shorthold Tenancy (AST) templates with new periodic agreements.
- Check clauses on rent increases, notice periods and possession grounds.
- Remove outdated references to Section 21.

3. Audit Property Condition & Compliance
- Inspect all properties for damp, mould, and repair issues.
- Make sure compliance certificates (EPC, gas, EICR, smoke/CO) are current.
- Keep dated records of maintenance work and communications.

4. Plan for Possession Scenarios
- Familiarise yourself with the new Section 8-style grounds (rent arrears, anti-social behaviour, landlord sale, family move-in etc.).
- Start keeping evidence logs now (texts, emails, inspection notes) to support future possession claims.

5. Update Rent Review Process
- Only one rent increase per year, with proper notice.
- Rent must reflect local market values not speculative bidding.
- Tenants can challenge excessive increases.

- Discuss with your property manager if you’re unsure about new obligations.
- Regular, clear communication helps avoid disputes later.
